1. Introduction
1.1. Fido Micro Credit LTD (“Fido”) is an entity incorporated in Ghana and is regulated and licensed by the Bank of Ghana. Fido is primarily engaged in the business of providing Credit Facilities to individuals and Micro, Small and Medium Enterprises.
1.2. Fido in partnership with Maxbuy Ghana LTD is offering a credit facility to eligible customers to enable them finance the purchase of Approved Smartphones (“Smartphone”) (the “Product”).
1.3. All applications for this credit facility from Fido are exclusively made, and approved electronically.
1.4. You have voluntarily applied for or are considering applying for a credit facility from Fido to purchase a Smartphone.
1.5. By applying for a credit facility from Fido to purchase a Smartphone, you agree to these terms and conditions as well as Fido’s General Terms & Conditions. If there is any conflict between these terms and conditions (“T&Cs”) and Fido’s General Terms of Service, these T&Cs shall prevail.
2. Scope and Applicability of Terms
2.1. This document sets out the T&Cs that will govern your relationship with Fido if you apply for a credit facility to purchase an Approved Smartphone. Please read these T&Cs carefully.
2.2. This Smartphone financing product is only available to eligible Fido customers who purchase a Smartphone from the Fido app.
3. Eligibility
Fido shall offer this Product only to a selected segment of customers and may change the eligibility criteria or discontinue this Product at any time at its sole discretion.
4. Application
4.1. During the application process, you will be required to select the Smartphone you want to purchase, your desired pickup location as well as your repayment terms.
4.2. Fido shall provide you with a Pre-Agreement Disclosure Statement which summarizes the important terms of the credit agreement (the “Agreement”), including repayment details, before the Agreement is concluded.
4.3. Where your application is successful, the Smartphone shall be made available to you by Maxbuy at the pickup location you selected.
4.4. Fido shall finance only one Smartphone purchase at a time; if you have an outstanding Smartphone credit facility with Fido, you cannot make another application. If you breach this provision, Fido reserves the sole right to terminate the Agreement, and any amounts including interest and any fees you owe Fido shall be immediately payable. Fido shall not in any way be liable to you for such termination. All losses and damages suffered by you before, during and after the said termination shall wholly be borne by You.
5. Collection
5.1. Upon your arrival to collect your order from your selected pickup location, you shall be required to provide your National ID and a pickup code which would have been provided after your order is placed in the Fido app. Your pickup code will also be communicated to you through SMS. Your credit facility Agreement shall take effect once you have picked up your Smartphone.
5.2. Where your Smartphone is not delivered to your selected pickup location within the communicated time frame you are required to notify Fido within three (3) days following the date on which the Smartphone should have been collected. Such notification may be done via email to buynow@fido.money, or by contacting our customer support phone number.
5.3. Where Fido receives such notification as specified in clause 5.2, Fido may choose to make changes to your repayment schedule at its sole discretion after an inquiry into the matter.
5.4. Should you fail to collect your Smartphone within five (5) days after it has been delivered to your pickup location, your Smartphone order will be cancelled.
6. Fees, Interest & Repayment
6.1. The applicable fees and interest on your credit facility shall be as stated in the Pre-Agreement Disclosure Statement.
6.2. Your repayment amount and schedule shall also be stated in the Pre-Agreement Disclosure Statement.
7. The Smartphone
7.1. The prices for the Smartphones may change from time to time, as determined by Maxbuy.
7.2. The colour of the Smartphones provided to you at the pick-up location will be based on availability. Fido makes no guarantees about the availability of the selected colour.
8. Returns
8.1. Returns of Smartphones purchased under this Product shall be in accordance with Maxbuy’s Returns and Refund policy.
8.2. TAKE NOTE THAT UNDER NO CIRCUMSTANCES WILL YOU BE ELIGIBLE TO RETURN THE SMARTPHONE IF YOU BREAK THE SEAL ON THE BOX.
8.3. If you return the Smartphone and Maxbuy processes a refund to Fido, you will be charged a cancellation fee of 4% of the principal amount of your credit facility.
8.4. You will only be allowed to return the Smartphone under clause 8.3 if you have not broken the seal on the box.
9. Responsibilities
Please take note of the following:
9.1. Fido shall bear no responsibility for the quality of the Smartphone as this is solely the responsibility of Maxbuy.
9.2. Maxbuy shall ensure that the Smartphone is delivered to the appropriate pickup location within the stipulated time period and that the Smartphone is stored safely until pickup.
