Salary Advance T&C

Introduction

1.1 Fido Micro Credit Ltd (Fido) is a private company incorporated in Ghana, regulated and licensed by the Bank of Ghana and is primarily engaged in digital moneylending. 

1.2 Fido is launching a Salary Advance Product (the Product) to New Customers (Customers) via a Weblink.  Salary Advance.

1.3 Through the Product, Customers will be able to apply for and receive a Salary Advance by uploading valid and recent (last six months) salary slips.

1.4 All applications for the Product shall be exclusively made and approved using the Weblink (the Link) and any other platform that may be created from time to time.

1.5 By applying for the Product and uploading your salary slip, you agree to these terms and conditions as well as Fido’s End User License Agreement. EULA

1.6 If you do not agree with these T&Cs, do not proceed with the application process, i.e., do not upload your salary slip.

Overview

2.1 This document sets out the terms and conditions that will govern your relationship with Fido if you apply for the Product. Please read these terms and conditions carefully.

2.2 The Product is only open to eligible Fido Customers.

Eligibility/Application Process 

3.1 Fido shall open the Product for application to individuals who: Are Ghanaian residents aged 18 years and above;

Are first-time users of the Link;

Access the Link through the unique weblink provided using a phone number that is later used for registration in the Fido App;

Are formally employed and able to upload valid, recent salary slips which are subsequently approved by Fido as part of the application process;

Successfully apply for and receive the Product via the Link during the Campaign period.

3.2 Application for the Product through any other channel or with inconsistent phone numbers shall render a Customer ineligible. 

3.3 Employees of Fido and its affiliates are not eligible to participate in the application for the Product.

4. Reward

4.1 Eligible Customers will receive a one-time monetary reward of Twenty Ghana Cedis (GH¢20) (the "Reward") during the Campaign period upon satisfaction of the Eligibility criteria in 3.1 above.

4.2 The Reward shall be disbursed weekly to the registered mobile money wallets of all entitled Eligible Customers.

4.3 Fido retains the sole discretion to determine whether the eligibility criteria has been fulfilled prior to disbursement of the one-time monetary reward. 

4.4 Uploading a salary slip or completing the application process shall not, in itself, entitle an eligible Customer to the Reward.

5. Reward Fulfillment

5.1 Subject to fulfillment of all the eligibility criteria set out above, the Reward shall be granted to the Customer via mobile money transfer to the mobile money wallet used during the application process.

5.2 The Customer is solely responsible for ensuring that the registered mobile money wallet is active and capable of receiving mobile money payments.

5.3 If, for any reason, Fido is unable to successfully complete the mobile money transfer to the provided mobile money wallet, the Customer shall be deemed to have forfeited the Reward.

5.4 In such cases, Fido shall have no responsibility or further obligation to the Customer, and no alternative form of compensation shall be offered.

6. Participation Requirements

6.1 To participate in the Campaign and be considered for the Reward, Eligible  Customers must:Click on and apply for the Product through the Link;

Complete the application process in the Fido App;

Upload a valid and recent salary slip that meets Fido’s minimum submission standards, including clear visibility and legibility of key information.

Apply for the Product;

Receive Loan approval and disbursement within the Campaign period.

6.2 Fido shall review all salary slips and in its sole discretion reserves the right to reject any document it deems fraudulent, incomplete, illegible, or otherwise unsatisfactory. Fido is under no obligation to disclose the reasons for rejection.

6.3 Submission of a salary slips does not constitute automatic entitlement to the Reward.

7. Scope and Modification

7.1 Fido reserves the right to verify the authenticity of documents submitted and may disqualify any eligible Customer engaging in fraudulent or suspicious activity.

7.2 Fido reserves the right to amend, suspend, or terminate the Product, or any aspect of it and these T&Cs, at any time without prior notice and without liability.

7.3 Fido’s decisions in relation to the Campaign, including eligibility, reward disbursement and interpretation of these T&Cs, shall be final and binding.

8. Anti-Fraud and Coercion

8.1 The Customer shall not engage in any fraudulent, deceptive, suspicious or abusive conduct in connection with this Campaign.

8.2 Fido may report suspected misconduct to relevant authorities and reserves all rights to pursue any legal remedies available.

8.3 Fido reserves the right to disqualify any Customer from participation in the Campaign, and to withhold or cancel the Reward, where Fido determines, at its sole discretion, that the Customer has engaged in fraud, misrepresentation, manipulation of the process, or any activity that undermines the integrity of the Campaign.

9. Data Privacy

9.1 By participating in the Campaign, you consent to the collection, use and processing of your personal information in accordance with Fido’s Privacy Policy and the applicable Data Protection laws in Ghana.

10. Limitation and Exclusion of Liability

10.1 Fido shall take steps to remedy any error in any electronic document submitted by you or any other error relating to other aspects of Fido’s services and resources when it becomes aware of the error.

10.2 You shall be responsible for the safekeeping of all your credentials (such as pin code) used to access Fido’s services and resources and Fido shall in no way be responsible for any loss or damage arising from the activities and/or fraudulent act(s) of third parties.

10.3 Fido shall not bear any liability to you for damages which you may suffer as a result of transmission errors, technical faults, malfunctions, illegal intervention in network equipment, network overloads, malicious blocking of access by third parties, internet malfunctions, interruptions or other deficiencies on the part of internet service providers (all together hereafter referred to as "system errors").

10.4 You acknowledge and agree that access to Fido's services and resources may be limited or unavailable due to such system errors, and that Fido reserves the right, upon notice, to suspend access to its online services and resources for this reason.

10.5 In no event shall Fido be liable to you for any incidental, special, consequential, direct, indirect, or punitive damages, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not Fido has been informed of the possibility of such damage.

10.6 Any liability incurred by Fido in connection with the Campaign shall be limited to any reward due you.

10.7 To the maximum extent permitted by applicable law, in no event shall Fido be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) however caused and on any legal or equitable theory of liability, and whether or not for breach of contract, negligence or otherwise, even if Fido has been advised of the possibility of such damages. These limitations will apply notwithstanding any breach of condition(s) or fundamental terms(s) or for a fundamental breach(s). In any case, Fido’s entire liability under any provision of the T&C shall be limited to your Loan amount outstanding with Fido or the minimum Loan amount given by Fido pursuant to a Loan agreement. This limitation of liability is cumulative with all Fido’s expenditures with respect to the liability being aggregated to determine satisfaction of the limit.

11. No Partnership Or Agency

11.1 Nothing in these T&Cs is intended to, or shall be deemed to, establish any partnership, joint venture, or agency relationship between you and Fido, or authorize you to make or enter into any commitments for or on behalf of Fido

12. Confidentiality And Information Security

12.1 You, together with Fido, agree that you shall take reasonable measures to maintain the confidentiality, integrity and availability of Proprietary Information received and shall not undertake any action which undermines the integrity and availability of any such information.

12.2 Excluded from the provisions of the preceding paragraphs are all data, information and documents that, legally or contractually, must be rendered or submitted to any public entities, financial institutions, insurance organizations, credit bureaus, or consultants in the scope of their duties, as well as disclosures that are required to honor any other duty established by law. In such cases the requested information should only be presented to the authority or entity that is entitled to the information and must be strictly limited to the necessary information to achieve the defined objective.

13. Representations

13.1 All representations made by you are true and accurate as of the applicable date of the Campaign. You further undertake to immediately notify Fido about any changes in any representation made.

14. Miscellaneous

14.1 Fido may cede, assign or novate any or all of its rights and / or all of its obligations set out in these T&Cs to any person or entity without notice or recourse to you.

14.2 The failure by Fido to enforce any of the rights or provisions of the Campaign or these T&Cs will not be deemed to be a waiver of such right or provision.

14.3 If any provision in these T&Cs is held to be invalid or unenforceable, the remaining unaffected provisions shall remain in full force and effect.

15. Governing Law and Jurisdiction

15.1 These T&Cs shall be governed by the laws of the Republic of Ghana.

16. Dispute Resolution

16.1 All disputes arising hereunder shall initially be resolved amicably between the Parties within five (5) business days of its occurrence.

16.2 Where amicable settlement fails, the Parties shall resolve the dispute through arbitration under the Alternative Dispute Resolution Act, 2010 (Act 798) as amended. The decision of a sole Arbitrator shall be final and binding on both Parties.

16.3 The arbitral tribunal shall be constituted by a Sole Arbitrator jointly appointed by the Parties.

16.4 Where you and Fido fail to mutually appoint an arbitrator two (2) weeks after the service of a Notice of Arbitration, either party shall apply to the Ghana Arbitration Centre for Arbitration in Accra to appoint a Sole Arbitrator.

16.5 The venue of the arbitration shall be Ghana and the applicable law shall be the Laws of Ghana.

16.6 The arbitrator's fees, together with all the administrative expenses to be incurred in holding the arbitral proceedings, shall be borne equally by you and Fido.
